OVERRULING E A SUPERAÇÃO DO ENTENDIMENTO DA CONFUSÃO PATRIMONIAL NA FIXAÇÃO DOS HONORÁRIOS DA DEFENSORIA PÚBLICA OVERRULING AND OVERCOMING THE UNDERSTANDING IN THE SETTING OF PUBLIC DEFENDER'S FEES
Resumo
RESUMO. Caracterizado o entendimento pacificado do enunciado de Súmula nº 421 do Superior Tribunal de Justiça - STJ, referente a vedação da condenação em honorários advocatícios em favor da Defensoria Pública da União -DPU, quando litiga em face de ente público ao qual pertença, busca-se com o presente artigo analisar a evolução legislativa e os efeitos no sistema jurídico constitucional implicando verdadeira força motriz a fundamentar a necessária alteração do referido precedente judicial, através de técnica de superação de precedente - overruling.

ABSTRACT. The pacified understanding of the Precedent No. 421 of the Superior Court of Justice (STJ), referring to the prohibition of condemnation in legal fees in favor of the Federal Public Defender's Office, when litigating against a public entity to which it belongs, we search with the present article to analyze the legislative evolution and the effects in the constitutional legal system implying real driving force to justify the necessary alteration of the aforementioned judicial precedent, through a technique of overcoming precedent - overruling.
